The intense nature of international communication in the current century, coupled with the increase in the exchange of documents, has made mutual agreements increasingly important. To prevent all this confusion and to ensure that the certification systems used by countries are brought under a single umbrella, the apostille certification system was introduced. As a result, documents certified by the competent authorities recognised by both countries retain their validity without any issues.
In our country, the need for this type of approval came to the fore much later than in other countries. The main reason for this was the failure to achieve development and the inability to commence import and export transactions with other countries. Diplomatic relations between Türkiye and European countries began much earlier than economic ties. As statesmen held the authority in diplomacy and acted as the competent authority in the treaties concluded, there was naturally no need for approval from a separate body. However, in today’s climate, significant progress has been made in both the economic and political spheres, and even in the area of tourist travel. As a result of these developing relations, there has been a substantial increase in the flow of official documents. This situation has highlighted the need for a certification system that is recognised by all countries. Türkiye joined the Apostille system, the rules of which are set out in the Hague Convention of 6.10.1961, on 29.09.1985 following its publication in the Official Gazette No. 18517 dated 16.09.1984.
This convention stipulates that official documents issued in the signatory states and certified by the competent authorities (District Governor’s Office, Provincial Governor’s Office, Judicial Authorities) may be used in other signatory countries. Consequently, the apostille certification not only saves time but also facilitates the processing of such documents. Official documents are required for tourist trips to other countries, trade fair visits, economic cooperation meetings and even university enrolment procedures. Firstly, for these documents, the text of the official document in your possession must be translated into the language of the destination country; you must then consult the relevant authorities and obtain an apostille through the District Governor’s Office in districts or the Provincial Governor’s Office in provinces. There are approximately 100 countries that are signatories to the Hague Convention. However, whilst some of these countries have not signed the Convention, they have recognised Article 12 thereof. The Hague Convention is drafted in English and French. It is stipulated that, in the event of any discrepancy in meaning between the texts in these languages, the French text shall prevail. The reason given for this is that French carries fewer connotations. The document must bear the French apostille certification (Apostille Convention de La Haye Du 5 Octobre 1961). It is required that the entire document be translated into one of the English or French languages, as well as into the language of the country in which it was issued.
